- What is a disabled person, Types and levels of disability.
According to Clause 1, Article 2 of the Law on Disabilities 2010, a person with disabilities is a person who has a defect in one or more body parts or has a functional impairment manifested as a disability that makes work, daily life, and study difficult.
Types of disabilities and levels of disabilities are specifically regulated in Clause 1 and 2, Article 3 of the 2010 Law on Disabilities, as follows:
- Types of disabilities include:
- mobility disability;
- Hearing and speech disabilities;
- Visual impairment;
- Neurological and mental disabilities;
- Intellectual disability;
- Other disabilities.
- People with disabilities are divided according to the following levels of disability:
- A person with a particularly severe disability is a person whose disability prevents them from performing daily personal activities;
- Severely disabled people are those whose disabilities result in the inability to perform certain tasks to meet their daily personal needs;
- People with mild disabilities are those with disabilities that do not fall under the provisions of Point a and Point b of this Clause.
- Rights and obligations of people with disabilities.
The rights and obligations of people with disabilities are stipulated in Article 4 of the Law on Disabilities 2010, as follows:
- Persons with disabilities are guaranteed the following rights:
- Equal participation in social activities;
- Live independently, integrate into the community;
- Exemption or reduction of a contribution to social activities;
- Receive health care , rehabilitation, education, vocational training, employment, legal aid, access to public works, means of transport, information technology, cultural services, sports, tourism and other services appropriate to the type and level of disability.
- Other rights as prescribed by law.
- People with disabilities perform their civic duties as prescribed by law.
- State policy on people with disabilities.
According to the provisions of Article 5 of the 2010 Law on Disability, which stipulates state policies on people with disabilities, as follows:
- Every year, the State allocates a budget to implement policies on people with disabilities.
- Prevent and reduce congenital disabilities, disabilities caused by accidents, diseases and other risks leading to disabilities.
- Social protection; support for people with disabilities in health care, education, vocational training, employment, culture, sports, entertainment, access to public works and information technology, and participation in traffic; prioritize implementation of social protection policies and support for people with disabilities who are children and the elderly.
- Integrating disability policies into socio-economic development policies.
- Create conditions for people with disabilities to receive orthopedic and rehabilitation treatment; overcome difficulties, live independently and integrate into the community.
- Training and fostering people working in counseling and caring for people with disabilities.
- Encourage disability benefits.
- Create conditions for organizations of people with disabilities and organizations for people with disabilities to operate.
- Rewarding agencies, organizations and individuals with achievements and contributions in helping people with disabilities.
- Strictly handle agencies, organizations and individuals that violate the provisions of this Law and other relevant legal provisions.
Through the regulations, we can see that our state cares a lot about people with disabilities, which is demonstrated through policies to protect their rights and create conditions for them to integrate into the community. Legally, our state has clearly stipulated the rights of people with disabilities in the Law on Disabilities and guiding documents, to ensure that they are treated equally and are not discriminated against. In general, these policies not only demonstrate the State's deep concern for people with disabilities but also contribute to promoting social equality, helping them have opportunities to develop and integrate into the community comprehensively.
